Which is where the judge's point about the baker telling them "I don't make GAY wedding cakes" instead of waiting to hear what they wanted on it, then turning them down on religious grounds.
It may seem a little silly, or a loop hole, but there it is. If the men in question simply wanted a plain ol' 3 tiered wedding cake with nothing on it, he'd have to make it (unless he suddenly had a lot of back orders). But saying, "I don't do GAY" is unlawful discrimination.

That makes sense. I guess I just don't see why they fought so hard to give this guy their money. They forced him to do something he didn't want to and had to pay him for it. What was their actual victory? Not to mention that if I were them, there's no way I would've eaten that cake.

Well, that's what I'm unclear about. The ACLU sued the guy "on the couple's behalf." I don't know if that means they called the ACLU, they wanted it, or if the ACLU can just do this without their consent.
I do know that they got their rainbow cake elsewhere.
I don't think the ACLU could sue without their consent - they wouldn't have standing to bring the suit, or so I imagine. But that doesn't mean the guys were going cakeless until the suit settled.
