It would depend on where/how he viewed her. IMO, if she's ************ in full public view, windows open and visible to an easily accessible public space, then she's at fault, not him. However, if he had to intentionally go to somewhere unusual where he could peer into her window, then that's a completely different story. It's the difference between looking through someone's window and watching them while you're standing on the sidewalk, and climbing up a tree in order to have a view into said window.

It says he was on a platform, but was this just in a normal area, or did he have to climb somewhere to have a view into her home? The linked page isn't super clear on that.

Given the nature of the media, I think had the story been "Man climbs to top of light post to film woman ****************** or "Man climbs on top of ticket booth to film woman ****************** they would have gone that route for the shock of it.

Now, the question in my mind. What's this gal look like?

Depends on what angle they want to cover. The link in the OP appeared to be more opinion than news, so it would not surprise me for certain details to be left out. However, this is an actual news story on the event, and from that (and the picture) it appears as though he likely didn't have to go out of his way to see into the window in question.

I'd ask if people are really so stupid as to not realize that their window opens directly (like 10 feet away) to a high traffic area, but I once lived in a housing complex with lots of young college kids. You'd be amazed how many people really don't seem to grasp that windows are transparent in both directions.
