Is this an honest statement? Because "I just don't understand how," and "I can't imagine how," are common idioms used to express disappointment, but are rarely meant to be taken literally.

For those pushing back the hardest, gay marriage isn't just something they think is wrong or flawed. It's part of their world view. For people who call gay marriage an attack on marriage--and who mean it and not merely use it as a rhetorical device--you are taking something away from them. You're telling them the world isn't the way they think it is. It's telling them it's ok for them to practice their beliefs over there in their little corner, but that it doesn't really apply to anyone else.

I can understand what they are feeling and why they are feeling it, but it's still wrong.

I would have thought sooner, actually.

CEO of the women's health company I've been consulting for essentially endlessly (I'm fairly certain we're common law married in West Virginia at this point) said something along the lines of "the ****?". Then their lobbying arm performed an operation along the lines of the US Military blasting music at Manuel Noriega, to the tune of "fix this, now".

The 2-1 decision by a panel of the U.S. 9th Circuit Court of Appeals found that Proposition 8, the 2008 ballot measure that limited marriage to one man and one woman, violated the U.S. Constitution. The architects of Prop. 8 have vowed to appeal.


Yay, and quite a snappily written decision. Extremely weak on the merits, unfortunately. Scalia, Alito, Thomas, Roberts certify, Kennedy joins in overturning, Roberts writes the decision Scalia writes something funny, Thomas writes something defensive sounding, Sotamayor writes the dissent. Coming to a court near you mid 2013.

I'm so tempted to offer a wager on that. I think it'll be struck down on the narrow basis of equal protection based on the merits of the specific case offered by the fairly ridiculous Prop 8 camp, with no decision on the Constitutionality of same-sex marriage as such.

I'd take that bet, in a heartbeat. First of all, it's exceptionally unlikely that if certified, it wouldn't be overturned. Unfortunately, California has the ludicrous direct democracy initiative laws I'm sure you're familiar with, so for Scotus to affirm they have to find space for ignoring the stare decisis of that process, and repeal of the state's constitutional amendment based on a federal constitutional argument.

The one you propose would almost have to call DOMA in question and open the floodgates for cases in every state, and we'd have circuits ruling differently and sCOTUS being forced to look at it again, etc.

They're well aware of all of that. If they certify, it'll be to overturn. If they're sympathetic, they'll decline to review it. I'd say given the current makeup of they court, it's 65/35 they'll certify.

New law's rarely made in predictable fashion though, so who knows. Maybe Roberts is ready to make a statement we don't expect.

Don't get me started. That plus the requisite super majority to get anything done drive me crazy. Not that I don't appreciate every lunatic in the state having the chance to get their precious referendum on the ballot, but it's a lot to slog through come election time.

The obvious misspelling of the word was the hint that it was a joke. There isn't any reason why ANYONE shouldn't use Celsius. I was just giving the ignorant response that people like to make.
