This type of law basically states that anything used to annoy, threaten or harass (many things you have done previously) over the internet, anonymously, will get you tossed in jail.

That's a great law there. It basically cuts out free-speach due to the subjective nature of what constitutes annoy, etc.

You, with your GIANT BEACH OF A ******, theoretically put everyone that has insulted you in jail. Does that make good law?

You'd be laughed at so hard it would rememind you of your prom.

now i dont know enough about the internet to know if what that person did would count as "utilizing a device or software" that has the intent to annoy, abuse, etc etc. it sounds like it does. but then the further question is whether the speech is protected under first amendment. plenty of legal scholars have already debated that this law is unconstitutional in a number of different situations under the first amendment. so even if the intent her was to annoy or harrass, it could be protected under the first amendment.

plus, this is somethng that would be a criminal sanction so it's not as if the kid could do something civilly to protect him/herself.

so my long answer is, theoretically it sounds like it violates the new law, but practically, it doesn't make a lick of difference because very little would happen anyway.
