Even in instances where there is a "mandatory jail sentence", there are cases, very many of them, where no time is served. NY State has a "mandatory" sentence for getting caught with an unlicensed handgun. It's routinely suspended.
This judge has already tossed out the most serious charge aganst Martha - hardly a sign of hostility. Could she do jail time? Sure, up to 20 years. Will she? I doubt it. If she does get sent up the river, and it isn't suspended, it will be a minimal term, most of which she'll dodge with good behavior or some such nonsense.
