It depends on whether or not there are dotted lines on the road indicating that through traffic should move right (your diagram seems to support this). If there are it becomes a turning lane and it's his fault as he shouldn't have crossed the line unless he was turning, if there aren't you are responsible to merge safely since technically passing on the right is an illegal maneuver (though without an accident you would never be charged for it as the intent is to allow you to bypass turning vehicles) and without the lines on the road its not considered a second lane.
Well, on my way back from work yesterday, I looked at the lines a little more closely.
The first T-intersection that I pass, the lines on the road look exactly like that in the picture, where an angled branch seems to direct straight traffic around a left hand turn lane.
The second T-intersection, there is a line on the right hand side, but no angled line branching off from the main, allowing you to drive straight through or around without ever crossing a line on the road.
So at the first intersection, it'd probably end up being his fault. On the second it'd be my fault. (I cannot remember which intersection it occurred at)
As for having to brake to do what I can to avoid accidents... ya, I know that. But sometimes I get angry and don't like braking, usually when someone pulls out in front of me when I'm way to close to an intersection I'll wait til the last moment to brake as revenge. (Not in this case, I did brake as soon as I saw the vehicle.) Probably bad thing to do, but when I'm 25 feet from a corner doing 55mph, turning into the lane I'm in is VERY annoying. Even more so when I'm the only car on the road and they just decided that 10 seconds was too long to wait before merging.
