I sent the following email to ebay customer support and included the seller ffxi_overstock in the seller ID report box.

Message: My problem is this. I am a player of the online game Final
Fantasy XI. It has come to my attention that you have numerous listings
on ebay that are illegal due to the Square-Enix agreement with their
players. These sellers are selling in game money called gil. I have a
list of sellers names, but they have numerous listings (around 200+) for
"gil". I have cut and pasted the Square-Enix policy about this and am
curious if we can report by name the violators?
The policy follows and can be found in full at the following link:
https://secure.playonline.com/supportus/index03.html 3.1 Prohibited Activities.
You may not use the Game or PlayOnline for any activities that are
illegal, fraudulent, or a violation of the rights of any third party.
Without limiting the generality of the foregoing, the following acts and
activities are strictly prohibited and shall, without prejudice to any
other rights or remedies that SEI may have, be cause for immediate
termination of your PlayOnline account and your right to play the Game (or
any other services) in connection therewith:
(a) Any activities consisting of selling, purchasing or exchanging
“gil” or any other currency that may be used in the Game from time to time,
characters, and/or Game items for value (including, but not limited to,
any payment in kind and any payment in any currency recognized as legal
tender in any country, state, territory or other jurisdiction anywhere
in the world) through any means or venue, including, without
limitation, Internet auctions or other online exchanges;
Please let me know what eBay is planning on doing, for I am concerned
with ebay's policies as well as Square-Enix's policies.
Thank you very much

This is the response I received from eBay.
"Hello Josh,
Thank you for taking the time to investigate eBay policy regarding this
item.
While eBay policy does not specifically prohibit the listing of these
sorts of "virtual items", you should be aware that many rights owners
may take the position that the listing of such items is a copyright
infringement. Listing such items could therefore result in the ending
of
such listings if a member of our Verified Rights Owner (VeRO) Program
reports the items as infringing their rights.
If you believe an item is potentially infringing and it was not removed
by eBay, we encourage you to contact the rights owner and inform them
of
the alleged infringement. Rights owners may request the removal of
listings they feel infringe upon their rights through eBay's Verified
Rights Owner (VeRO) Program.
If you would like to see information provided by the rights owners
about
items that may infringe their rights and how to contact them, please
visit our list of VeRO Program participant About Me pages.

We appreciate your concerns and we thank you for helping to keep eBay a
safe and reputable forum in which to conduct business.
Thank you for your understanding in this matter.

I for one will now reconsider using eBay in the future...talk about a run around... I check the site they directed me to and saw that SE is not listed there. I am concerned with eBay's lack of legal enforcement in this issue and am wondering what actions SE will be taking, considering this is in blatant disregard for your FFXI Players Agreement. Please set the minds of your players at ease, by letting us know what will be done. I will share your response with the forums I post in and look forward to hearing from you.
Thank you very much, your concerned and loyal player
