You can report this guy to eBay (quoting the part of the ToS that bans this) and they should suspend the auction, and possibly this guy's account.

I have reported the auction to eBay AND PlayOnline.

Those who buy gil, bot, and cheat in this game should never be allowed at all to play. Those that do shouldn't even exist at all.

Well, the auction listing has been removed. I guess reporting it to eBay and Playonline does work. o.O

Yes, I think I'll need help.

Why?

Well, typing in 'Final Fantasy XI gil' in the search query resulted in 230+ results, including those guides on how to get 1.5 mil in so and so amount of time. ; ;

Too... many... item... numbers... to... report. >.<

I highly doubt the guides to make money are against the agreement unless the guides contain something that would violate the TOS. But, I am assuming right now, that they don't.

Okay I sent the following email to ebay customer support and included the seller ffxi_overstock in the seller ID report box.

Report problems with other eBay members > Problems with sellers > The
problem you're having with your seller isn't listed

Member or Item being reported: ffxi_overstock

Message: My problem is this. I am a player of the online game Final
Fantasy XI. It has come to my attention that you have numerous listings
on ebay that are illegal due to the Square-Enix agreement with their
players. These sellers are selling in game money called gil. I have a
list of sellers names, but they have numerous listings (around 200+) for
"gil". I have cut and pasted the Square-Enix policy about this and am
curious if we can report by name the violators?

GREAT JOB!!

I did something similar, maybe we should get a round up of every player in FFXI to keep sending stuff like this to eBay. Maybe eBay will get smart about what's being posted on their site and completely disallow it. It's good to know there are people like you and I taking an active role in stopping people who sell gil online. Hoorah to us!

Ebay is horrible at yanking scam auctions, and banning sellers. I myself have been tracking various scams across ebay for the past couple years, and have noticed that Ebay, through its "hands off" policy, rarely critiques sales. And even when fraud is proven, the seller is often given a temporary suspension, or in the case of a power seller (several thousand sells), not a simple slap on the wrist.

This pertains to a stamp scam that has been going on for a long time now, and has yet to be truly addressed by Ebay.

At one time, it was estimated that out of every one hundred autographed items on Ebay, only one or two is real.

Also, computer parts are the most likely catagory for the item to not be delivered (around 5%). Ebay policy says that the funds cannot be recovered less you use Paypal (which is owned by Ebay), to transfer the funds.

Hmmm...

Interesting, isn't it?

I for one will now reconsider using eBay in the future...talk about a run around... I check the site they directed me to and saw that SE is not listed there. I am concerned with eBay's lack of legal enforcement in this issue and am wondering what actions SE will be taking, considering this is in blatant disregard for your FFXI Players Agreement. Please set the minds of your players at ease, by letting us know what will be done. I will share your response with the forums I post in and look forward to hearing from you.

If my understanding of international copyright law is up to date (and I haven't looked into it for a while), electronic software as it is defined under the law is saleable insofar as the original purchaser is concerned, so long as the software is sold in it's original format (no duplications, i.e. burnt cds/dvds), and the law makes no distinction between your standard offline game and an online game that takes place within a persistant world.

Square-enix has its hands tied in a number of ways with regards to copyright infringement, for this reason. Additionally there is currently no legal convention to detail ownership so far as ubiquitous data in a persistant world is concerned. (i.e. gil) which is where they have difficulty prosecuting gil-sellers.

Essentially persistant online environments are new, and the law has yet to catch up.

It seems to me that the best way the law should approach things such as this would be to recognize persistant online environments as actual environments, as discreet regions under the ownership of its creators, rather than just as information.

This would allow existing laws to come into play, giving the proprietor of a given piece of persistant online property to prohibit soliciting within the confines of the environment under their purview.

Or something similar.
