D'you know what "trustee" is? Whoever the fuck you want it to be.
If you have a friend that's 17 and wants to play a little, you can remove the title of "trustee" and place it on your friend, until that person is done. Pretty much, as long as they aren't legally adults, you can let anyone play your account. You can even make a powerleveling service a "trustee", therefore loopholing the ToS, so long as they are underage.
So if you get banned for powerleveling, if your powerleveler is underage and you have no current trustee, you can argue its legitimacy in court.
Just a thought.

Technically a trustee is appointed by an operation of law much like a power of attorney. Yes, by definition a trustee can be anyone you'd like but normally it is a legal title.
Like everyone else has said, let him play, just make sure he keeps his mouth shut about it while he's on your account.

and yes blizzard can ban your account for letting your brother play.

...and while you're busy paying a lawyer thousands of dollars on a case you'll lose, you'll still be without WoW.
