New Mexico legalizes same sex marriage.

The New Mexico Supreme Court unanimously affirmed on Thursday the right of same-sex partners to marry in the state, reasoning that the “protections and responsibilities that result from the marital relationship shall apply equally” to them and to opposite-sex couples.

With the ruling, which takes effect immediately, New Mexico becomes one of 17 states and the District of Columbia to permit same-sex marriage. Thirty-three states limit marriage to opposite-sex couples.

Since the 2012 election, there's been eleven states to legalize same-sex marriage: three by public referendum, five by legislation and three via court decision. That number will slow down now as you hit more states with constitutional bans that are difficult to overturn due to the amendment process but interesting to think that 65% of the states allowing SSM did so within the last year and change.

I'm on mobile atm so I can't read the pdf but from other people's summarization of it it seems the judge was more than a little clear. He also didn't order a stay so gay couples in Utah are getting married now, at least until the next court up grants the emergency stay and starts the appeal process.

10th Circuit isn't really where you want this sort of case. Who knows, though, maybe the majority that ruled in favor of Hobby Lobby not having to offer birth control coverage to it's female employees via health insurance will uphold this. I wouldn't wager any money on it, but I wouldn't have guessed Roberts on ACA either.

10th overturning wouldn't be mature enough to get to SCOTUS. There would be a wait for a differing ruling from another circuit. Were they inclined to make a ruling on equal protection they could have stretched a little and made it already. If it's upheld, that's better for the people impacted while they wait and for the long term cause of clarifying that gay marriage is included in the rights granted by the US Constitution.
