I used to be very probush but this whole illegal immigration situation has gotten completly out of hand. It is from what i can see a rather broad law considering that losing ones temper to a child over the internet falls under the same catagory as the true offenders, the ones actually preying upon children.

I don't believe Kaolians intention was to be a predator so much as him losing his temper.

The actual Federal statute (as opposed to random Arizona laws) is indeed extremely vague and poorly worded. Under it, every single person on this forum I can think of would be guilty.

The reality is that the law has only been applied to a single case of internet harassment and that was a guy who spent two years sending hundreds, if not thousands, of harassing faxes and e-mails to a woman, started a website devoted to hating her, spoofed her em-mail to send **** to her co-workers, etc.

Nothing even remotely like posting a dynamic and worthless IP number. But if Niobia wants to live in her Kao hate-fantasy land, I guess there's no helping intentional ignorance.

I actually think they made the law vague so the government could prosecute who they feel they need to. I am not sure Kao falls in that catagory...

Another response to my thread on the other forum asking for information:

Anyone who thinks his IP address is ever private is completely deluded about how the Internet works and, in a perfect world, would get laughed out of court if he ever tried to testify as to matters involving computer networks. Your computer's IP address is one piece of information that must be known to outside computers and you, in general, have no control over what those computers will do with it.

The plus side is, as Shagnasty said, an IP address isn't all that personal in any event. Generally, the furthest it can be traced back is to a pool of addresses assigned to a specific ISP. You need a subpoena to get the ISP's records as to which address was assigned to which customer at which times. Some people run things like websites out of their homes and you can trace back the IP addresses of the computers hosting their websites back to their homes, but that still doesn't give you anything like a street address. The best you can do on an IP address alone is the town.

So, Niobia, so far we've determined that the IP address doesn't violate the Child Internet Protection Act and it doesn't constitute as Internet Harassment in any meaningful way under the Federal statutes. Are we ready to give up the "Kaolian gave out a childs IP address which is against the law." dog and pony show yet and admit that we were wrong or are you eventually going to cough up a real law? And laws from a state that neither party resides in don't count.

Hey I did my studies at UofA so sue me if I'm comfortable with Arizona.

You haven't proven that the IP address doesn't violate the Child Protection Act. Hearsay and opinion isn't factual evidence. Kaolian willfully gave out the IP address and encouraged the forum to "have at it" - a willful and destructive measure that does constitute as Cyber Harassment. However , on your side, we niether have evidence to support that this was more than a one time thing and it would appear by Ragneros "PM" that kaolian posted, that kaolian was instigated.

I don't need to prove that it doesn't. YOU need to prove that it does. Innocent until proven guilty and all that.

Given that the IP address fits none of the criteria, only identifies the town of the DSL provider and wasn't even pingable, I doubt you'd find a judge in the land who'd say it constituted "personal information". The sole "cyber harassment" law cited (which was by me since your cite was worthless) would include damn near any action and has absolutely no precedent in what you're claiming.

In other words, you're full of sh[Aqua][/Aqua]it.
