You don't need legacy to participate, they're just guaranteed a spot. If you applied then you'll get in, it's just a matter of which wave.
I believe phase 2 is when they'll start bringing in players who didn't qualify for legacy but have registered the game with a square enix account. So I'm guessing that'll be somewhere near or a little after march 1.
